These Terms of Sale apply to all sales of products or services Agua de Oro that you can order on the website www.aguadeoro.ch and via email.

The registered office of AguadeOro SARL. is located at 21, Grand-rue, 1204 Geneva, Switzerland (Agua de Oro "we", "us", "our" and "our"). Our VAT number is CHE-114.798.474.

By placing an order, you agree to be bound by the Terms of Use and Privacy Policy, the terms of which are incorporated into these Terms of Sale.

Please note that before ordering products or services, you will be asked to accept these Terms and Conditions of Sale.

UPDATES TO THESE TERMS AND CONDITIONS OF SALE

We may change these Terms and Conditions of Sale at any time. Therefore, please check them regularly for updates. The latest version will always be available on the Platforms. Any new version of these Terms and Conditions of Sale will take effect immediately on the date of publication.

Warranty

AguadeOro grants a three-year warranty on your jewelry (or other productAguadeOro) from the date of purchase. The warranty does not cover damage resulting from an accident (shock), lack of care or normal wear and tear of the jewellery. This guarantee covers the loss of small diamonds (mixed, up to 0.05ct for each diamond): if a small stone falls out of your jewelry, we will replace it free of charge.

Services

Overhaul and cleaning are offered for life.

If you have your jewelry serviced during the warranty period, the Scrum Replacement Service will be renewed for one year at each subsequent service.

Engagement ring:

Services

AguadeOro offers you a special service for your engagement ring: during the two years following the date of purchase, we will refresh your ring free of charge to revive its brilliance and we will also check the setting of the stones. We recommend that you have your jewelry checked regularly, which, depending on the use you make of it, should be done every one to three years. If one of the small (mixed) diamonds falls out of your jewel within this three-year period, we will replace it free of charge. If you come to the boutique for a service within one year before the end of the guarantee, this service is renewed. We also offer a free enlargement or shrinkage (if the variation does not exceed two sizes and you notify us of this within the first three weeks of the purchase date).

AguadeOro offers you a special service for yourWedding Band : during the two years following the date of purchase, we will refresh your ring free of charge to revive its brilliance and we will also check the setting of the stones. We recommend that you have your Wedding Band ring checked regularly, every one to three years, depending on the use you make of it.

Overhaul and cleaning are offered for life.

If you have your Wedding Band scrum service overhauled during the warranty period, the scrum replacement service will be renewed for one year at each subsequent overhaul.

ORDER ACCEPTANCE

We reserve the right to refuse orders and payments whose origins seem fraudulent to us.

PRODUCT AVAILABILITY AND QUANTITY

All orders have a detailed production lead time on each product and subject to availability of raw materials.

ACCOUNT REGISTRATION AND VALIDATION OF VISITOR PURCHASES

You can place an order either by registering and creating an account online, or by placing an order as a visitor (without creating an online account).

CUSTOMIZED SERVICES

Customization services (e.g. engraving, creation or modification) or other services can be offered on a selection of products.

We reserve the right to refuse acceptance of any order.

In addition, orders for customised products are not cancellable and products that have been customised in any way can not be returned to us for exchange or refund as described in these Terms and Conditions of Sale.

PRICES, TAXES AND DELIVERY CHARGES

Unless otherwise stated, all prices shown on the product pages of the Platforms or indicated by Customer Service are in Swiss francs (CHF), including applicable VAT, but excluding delivery costs and all other taxes.

Please note that changes in applicable law between the date you place your order and the date you receive a written Order and Shipping Confirmation may change the taxes associated with your order. If the resulting change results in an increase in the taxes charged to you, we will contact you and ask you to reconfirm your order.

PAYMENT

We accept the means of payment identified as part of the ordering process. Depending on the means of payment, we may request additional information, including any special form of identification.

At the time of ordering, you will need to provide your payment details on the appropriate form. All payment cardholders are subject to a validation check and authorization procedure by the card issuer. If your payment card issuer refuses to authorize payment to us, you will need to contact them directly to resolve the problem.

Other means of payment may also be subject to release controls and a payment system provider authorization procedure. You expressly authorize us to perform security checks as we deem necessary, to transmit or occasionally obtain information (including updated information) about you to or from third parties, including but not limited to your payment card details, for the purposes of authenticating your identity, validating your payment card, obtaining initial payment card authorization and authorizing individual purchase transactions.

The total amount of your purchase will be debited when you place your order. You will receive a payment confirmation by email with the details of your order and the delivery time. We will also send you an email when the order has been shipped.

We can accept any bank transfer in settlement of orders at our sole discretion. We do not charge a bank transfer commission for any order placed through our website or Customer Service. However, some banks may charge bank transfer fees. We require that all orders paid by bank transfer and placed by telephone be confirmed through an order approval process. We may acknowledge receipt of an order paid by bank transfer, but the order will only be processed after we have received payment and confirmed receipt by email. If your bank transfer is not credited to our bank account within seven (7) days of placing your order, your order will be cancelled.

ORDER ACKNOWLEDGEMENT

Once you have made your choice and placed your order through our website, you will receive an Order Acknowledgement (by e-mail or otherwise, confirming your order details and an order reference number). Please keep this order reference number in case you require further information about your order. This Order Acknowledgement does not constitute acceptance of your order. To confirm the order, we will carry out the usual legal, credit, fraud and security checks and related controls and, if satisfactory, we will then process your order. Upon receipt of the Order Acknowledgement, it is your responsibility to verify it and confirm that it accurately reflects your order intentions. If you have any questions or concerns or if the Order Acknowledgement does not reflect your intentions, you should contact Customer Services promptly.

These Terms and Conditions of Sale will be given to you as soon as we acknowledge receipt of your order.

SHIPPING POLICY

We only accept orders for delivery to the country(ies) identified during the Order Process. For more information, please consult our FAQ section or contact Customer Service.

ORDER AND SHIPPING CONFIRMATION

We will send you an Order and Shipping Confirmation in writing (by e-mail or otherwise) when we ship your order. This Order and Dispatch Confirmation constitutes acceptance of your order by us and indicates the existence of a binding contract of sale. 

DELIVERY

We will use reasonable endeavours to ensure that delivery is made by the carrier within the estimated delivery time from the date of our written Order and Despatch Confirmation, and in any event within thirty (30) days of that date, unless your purchase is for a product or service which will require additional delivery time as explained to you, for example, in the case of products or services which we customise to your instructions.

If the delivery of products is delayed by an event beyond our control, we will notify you as soon as possible and use all reasonable efforts to minimize the consequences of the delay.

When assessing your delivery time, please take into account the time required for payment approval, address verification, security checks and order processing. Please note that delivery is always subject to receipt of your full payment.

We will require a handwritten signature from you, or from any person at the delivery address provided, to confirm delivery of each product, after which the risk and responsibility for the products you have purchased is transferred to you.

INVOICES

After ordering products via our website, you will receive an invoice which will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise).

RETURNS AND EXCHANGES

(I) Right of cancellation

You have the right to cancel the order contract without giving any reason fourteen (14) days from the date you acquire, or any person you name (other than the carrier) acquires physical possession of the products in your order. If you are a customer located in the European Union or the European Economic Area and you have made a purchase through our website, this should be regarded as your legal right of withdrawal. In order to comply with the withdrawal period, you only need to withdraw from the contract before the expiry of the withdrawal period.

To cancel the contract and return your product(s), you can contact our Customer Service and follow the instructions given to you, or send us a written statement, such as a letter or e-mail to: sales@aguadeoro.ch.

(II) Return procedure 

Only products purchased through our website can be returned to: AGUAdeORO, CH-1204, Grand-Rue, 21 Geneva, Switzerland.

Steps to follow:

Contact us by email or phone. Send your package to any Swiss Post office (during the return period) with the Registered service. You must keep a proof of return shipment, and send by Swiss Post. For orders from abroad, please contact us to give you precise instructions as appropriate.

(III) Conditions for returning products

We will verify that the returned product meets the terms and conditions of the Returns and Exchange Policy and, if so, we will proceed with the applicable refund or exchange.

Our products must be returned in new and undamaged condition, in perfect condition, with all protective materials in place and accompanied by the manual certificates and other materials sent with your order.

If you received free items as part of your order, they must be returned with the products.
